Terms of Service

These Terms govern your use of Next Level Up (the "Service"), operated by Next Level Up ("we", "us"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy.

1. Who can use the Service

• You must be at least 18 years old and able to form a binding contract. The Service is for coaches, team staff and parents, not for players under 18.
• You're responsible for the accuracy of the information you provide and for all activity on your account.

2. One account per person

• Each account, and each coach seat on an Elite plan, is for one named individual. You may not share your login, resell access, or let others use your account.
• To protect accounts, we limit each account to a registered device and to one active session at a time. Signing in on a new device may sign you out elsewhere, and we may limit device changes.
• We may suspend or terminate accounts we reasonably believe are shared, resold, or used to get around these limits, without a refund for the current period.

3. What the Service does

• You upload box scores, results sheets and other game information (photos, screenshots or files). The Service uses automated tools, including artificial intelligence, to read that information and computes statistics, insights and reports from it.
• Automated reading can make mistakes. You review extracted data before saving it. Statistics, insights, pitcher availability guidance and reports are informational only.
• You are solely responsible for decisions about player participation and safety, including pitch counts and rest under your league's rules. Pitch Smart guidance is shown for reference and may differ from your league's rules.

4. Your content

• "Your Content" means box scores, images, team and player information and notes you upload.
• You confirm you have the right to upload Your Content and that doing so doesn't violate any law, anyone else's rights, or the terms of any other service the content came from.
• You keep ownership of Your Content. You grant us a limited license to host, process, analyze and display it to operate and improve the Service for you, including sending it to the service providers that process it for us (see the Privacy Policy).
• If you create a share link, anyone with the link can view that report until you turn sharing off.

5. Player information

• Box scores may include names, jersey numbers and statistics of players, some of whom may be minors. Upload only what's needed (box scores typically show a first initial and last name), use it only for legitimate coaching and scouting, and don't upload sensitive information such as health details, contact details or photos of players.
• You agree not to use the Service to harass anyone, recruit improperly, or publish information about minors outside the coaching context.
• Players and parents can ask us to correct or remove information by emailing eric.s.jaffe@gmail.com.

6. Plans, billing and trials

• Paid plans are billed in advance, monthly or annually, and renew automatically until canceled. Season passes are one-time purchases that cover 4 months and do not renew.
• Payments are processed by our payment partner, which acts as the merchant of record for your purchase and calculates, collects and remits applicable sales tax. Its terms also apply to the transaction.
• Free trial: first-time Pro subscribers may receive a 7-day free trial. A payment method is required. If you don't cancel before the trial ends, it converts to a paid subscription and you'll be charged. Trial usage limits apply, including a limited number of scans.
• Cancel anytime from Manage billing in your dashboard. Cancellation takes effect at the end of the current billing period, and you keep access until then. Except where required by law, we don't refund partial billing periods.
• Plan limits (teams, scans, seats) are described on the pricing page and may change with notice. Unused scans don't roll over.
• We may change prices with at least 30 days' notice before your next renewal.

7. Acceptable use

You may not reverse engineer or scrape the Service; use it to scrape or bulk-download data from other services; upload malware; try to access other people's accounts or data; or use the Service in violation of any law or third-party terms.

8. Third parties

Next Level Up is an independent product and is not affiliated with, endorsed by or sponsored by GameChanger, DICK'S Sporting Goods, MLB, USA Baseball, or any league or governing body. Trademarks belong to their owners.

9. Disclaimers and limitation of liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, INCLUDING THE ACCURACY OF EXTRACTED DATA OR COMPUTED STATISTICS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, AND WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES.

10. Termination

You can stop using the Service and ask us to delete your account at any time by emailing eric.s.jaffe@gmail.com. We may suspend or terminate access if you breach these Terms. Sections that by their nature should survive termination will survive.

11. Changes, governing law and contact

• We may update these Terms. We'll notify you of material changes by email or in the app; continuing to use the Service after that means you accept the updated Terms.
• These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Bucks County, Pennsylvania, and you consent to their jurisdiction.
